1. Acceptance of Terms

By downloading, installing, or using Mr. Spike ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Mr. Spike ("we," "us," or "our"). By using the App, you confirm that you are at least 13 years of age, or that if you are under 18, you have obtained parental or guardian consent.

2. Description of Service

Mr. Spike is a mobile application designed to support people with Type 1 Diabetes in managing low blood glucose (hypoglycemia) episodes. The App provides:

• Decision-support guidance for low glucose correction based on publicly available clinical guidelines
• Personalized suggestions that adapt over time based on your logged outcomes
• Educational information about blood glucose management
• A personal rescue foods library and logging functionality
• Pattern insights and weekly summaries

Mr. Spike is a decision-support tool. It is not a medical device, electronic health record, or clinical management system.

3. Medical Disclaimer

Mr. Spike is NOT a medical device. It is NOT intended to diagnose, treat, cure, or prevent any disease, including diabetes or hypoglycemia.

The App provides general decision-support information based on widely published diabetes management guidelines. This information is educational in nature and is not a substitute for professional medical advice, diagnosis, or treatment.

You acknowledge and agree that:

• You will consult a qualified healthcare professional or diabetes care team before making changes to your diabetes management
• You will not rely solely on Mr. Spike for any medical decision
• In case of a medical emergency (including severe hypoglycemia with loss of consciousness), you will call emergency services immediately
• The suggestions provided by Mr. Spike are general guidance, not personalized medical advice
• CGM readings, including those from FreeStyle Libre, may not always accurately reflect blood glucose levels — always use a finger-prick meter when in doubt

4. User Accounts

You may use Mr. Spike without creating an account (local mode). If you create an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Take responsibility for all activities that occur under your account

You may delete your account at any time through the app's Settings screen. Upon deletion, your data will be removed from our servers within 30 days.

5. Acceptable Use

You agree not to use Mr. Spike to:

• Violate any applicable laws or regulations
• Attempt to reverse-engineer, decompile, or tamper with the App
• Access or attempt to access other users' accounts or data
• Introduce malware, viruses, or malicious code
• Use the App in any way that could harm yourself or others

6. Intellectual Property

All content, features, and functionality of Mr. Spike — including the app design, code, graphics, logos, and trademarks — are the exclusive property of Mr. Spike and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Disclaimer of Warranties

Mr. Spike is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• The information provided will be accurate, complete, or current
• The App will meet your specific health or medical requirements

To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, Mr. Spike and its developers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the App
• Any health outcomes resulting from following or not following in-app suggestions
• Inaccuracies in blood glucose data or recommendations
• Unauthorized access to your account or data

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your access to Mr. Spike at any time, without notice, if you violate these Terms or if we decide to discontinue the service.

You may stop using the App at any time by deleting it from your device. If you have an account, you can delete it through the app's Settings screen.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of the applicable jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or by email at least 14 days before changes take effect. Your continued use of the App after that date constitutes your acceptance of the updated Terms.
